1R6. For the purposes of the definition of “small business corporation” in section 1 of the Act, a corporation is connected with another corporation at a particular time where, at that time,(a) it is controlled, within the meaning of subparagraph b of the first paragraph of section 739 of the Act, but otherwise than by reason of a right referred to in paragraph b of section 20 of the Act, by the other corporation; or
(b) it is a corporation, shares of the capital stock of which, representing more than 10% of the issued shares of its capital stock having full voting rights and more than 10% of the fair market value of the aggregate of the issued shares of its capital stock, are the property of the other corporation.
